These Terms of Service ("Terms") govern your access to and use of ClusterPrep ("ClusterPrep," "we," "us," or "our"). By using the app, you agree to these Terms. If you do not agree, do not use the app.
1. Who we are
ClusterPrep is a free, non-commercial web application, operated by an independent developer based in the United States, that helps students practice for DECA Career Cluster competitive exams. Questions about these Terms can be sent to clusterprep@gmail.com.
2. Eligibility
You must be at least 13 years old to use ClusterPrep. If you are under the age of majority where you live, you may use the app only with the involvement and consent of a parent or legal guardian. By using ClusterPrep you represent that you meet these requirements.
3. The service
ClusterPrep provides practice exams, study guides, flashcards, progress tracking, and leaderboards for personal, non-commercial educational use. The app is provided on an early-access / "beta" basis: features may change, break, or be removed, and the service may be unavailable at times. We may add, modify, suspend, or discontinue any part of the app at any time without notice or liability.
4. Your account
- You are responsible for choosing a username and password and for keeping your password confidential.
- You are responsible for all activity that occurs under your account.
- Because this is an independent, free service, account recovery may be limited. If you forget your password, contact us and we will help where we reasonably can, but we cannot guarantee recovery of an account or its data.
- You may delete your account and associated data at any time from within the app (account menu → "Delete account"). Deletion is permanent.
5. Acceptable use
When using ClusterPrep, you agree not to:
- Use the app for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to other users' accounts, the database, the servers, or any data you are not entitled to;
- Probe, scan, attack, overload, or disrupt the app or its infrastructure (including denial-of-service attempts);
- Scrape, copy, bulk-download, or redistribute the exam content or study materials, or use them to build a competing product;
- Publicly share any private-access password provided to you;
- Impersonate another person, submit content that is abusive, harassing, hateful, or obscene, or manipulate the leaderboard through cheating or automated means;
- Upload malware or otherwise interfere with other users' use of the app.
We may suspend or terminate access that violates these rules.
6. Intellectual property & exam content
The practice questions and exam material made available through ClusterPrep originate from sample exams published by the MBA Research Center and are the property of their respective owners. ClusterPrep does not claim ownership of that content; it is provided here as a study aid for personal, non-commercial use only. The ClusterPrep name, design, software, study guides, and original written explanations are owned by the operator and may not be copied or reused without permission. If you are a rights holder and believe content should be removed, contact clusterprep@gmail.com and we will respond promptly.
7. Not affiliated with DECA or MBA Research
ClusterPrep is an independent study tool. It is not created, sponsored, endorsed by, or affiliated with DECA Inc., the MBA Research Center, or any official DECA program. "DECA" and related names are used only to describe what the app helps you study.
8. No guarantee of accuracy or results
ClusterPrep is provided for study purposes only. Practice questions, answer keys, and explanations may contain errors and are not a substitute for official DECA materials or instruction. We make no guarantee that using the app will improve your scores or lead to any particular result in a competition or exam. You use the content at your own discretion.
9. Disclaimer of warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, secure, error-free, or that data will never be lost.
10. Limitation of liability
To the fullest extent permitted by law, ClusterPrep and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app. Because ClusterPrep is provided free of charge, the operator's total aggregate liability to you for any claim relating to the app will not exceed USD $0. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless the operator of ClusterPrep from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the app or your violation of these Terms or of any law or third-party right.
12. Termination
You may stop using ClusterPrep and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the app and its users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date above and, where appropriate, post a notice in the app. Your continued use of ClusterPrep after an update means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the app will be handled in the courts located in that jurisdiction, to the extent permitted by law.
15. Privacy
Your use of ClusterPrep is also governed by our Privacy Policy, which explains what data we collect and how we handle it. Please review it.
